Terms of Service

Please read these Terms of Service ("Terms") carefully before using ATL Ticket Exchange ("the Platform," "we," "us," or "our"). By creating an account or using any part of the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. What ATL Ticket Exchange Is

ATL Ticket Exchange is a peer-to-peer listing and communication platform. We provide tools for users to post ticket listings and communicate with potential buyers or sellers. We are not a ticket broker, ticket seller, or party to any transaction between users. We do not buy, sell, hold, transfer, or guarantee any tickets.

2. No Affiliation

ATL Ticket Exchange is not affiliated with, endorsed by, or sponsored by any professional sports team, collegiate athletic program, venue, league, Ticketmaster, SeatGeek, AXS, or any other official ticketing entity. All team names, logos, and trademarks are the property of their respective owners and are used for identification purposes only.

3. User Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when registering.

4. Listing Rules

You may only list tickets that you own or have the legal right to sell. You agree not to:

  • List tickets you do not possess or have no ability to deliver.
  • List counterfeit, invalid, duplicate, or stolen tickets.
  • Post misleading descriptions of seat location, quantity, or transfer method.
  • Use the Platform to engage in any fraudulent activity.
  • Violate any applicable federal, state, or local laws regarding ticket resale.

Violation of these rules may result in immediate account suspension or permanent ban, at our sole discretion.

5. Transactions Are Between Users — We Are Not a Party

ATL Ticket Exchange does not process, hold, or mediate payments between users. All transactions are conducted directly between buyers and sellers. We have no control over, and make no representations about, the quality, safety, legality, or authenticity of any tickets listed on the Platform.

You agree that ATL Ticket Exchange is not responsible for any harm, loss, or damage arising from transactions conducted through or as a result of using the Platform, including but not limited to fraudulent tickets, non-delivery, payment disputes, or event cancellations.

6. You Assume All Risk

All transactions on ATL Ticket Exchange are conducted at your own risk. We strongly recommend that buyers verify ticket authenticity and seller reputation before sending payment. We strongly recommend that sellers confirm payment receipt before transferring tickets. ATL Ticket Exchange expressly disclaims any liability for losses arising from peer-to-peer transactions.

7. Credits and Payments

Users may purchase credits to feature listings. Credits are processed via Stripe. All credit purchases are final and non-refundable except as required by applicable law. Credits do not expire. Featured listing credits are consumed over the duration of the featured placement. If a featured listing is cancelled, unused time is returned as credits to your account.

We reserve the right to change credit pricing at any time. Existing credit balances are not affected by price changes.

8. Prohibited Conduct

You agree not to:

  • Harass, threaten, or intimidate other users.
  • Use automated systems, bots, or scrapers on the Platform.
  • Attempt to circumvent any security or access controls.
  • Post spam, advertisements, or irrelevant content in listings or messages.
  • Impersonate any person or entity.
  • Use the Platform for any illegal purpose.

9. Moderation and Bans

We reserve the right to remove any listing, suspend any account, or permanently ban any user for any reason or no reason, at our sole discretion, without prior notice or liability.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ATL TICKET EXCHANGE AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED $100.

12. Indemnification

You agree to indemnify, defend, and hold harmless ATL Ticket Exchange and its owners, operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your listings, your transactions, or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Fulton County, Georgia.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
